Welcome to SecondSoil.

These Terms & Conditions ("Terms") govern your use of the SecondSoil mobile application, website and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Services.

2. Eligibility

You must be at least 16 years old to use SecondSoil.

By creating an account, you confirm that:

  • you meet the minimum age requirement;
  • the information you provide is accurate and up to date.

If you are under 18, you may only purchase a paid subscription or enter into a contract with us where you have the consent of your parent or legal guardian where required by applicable law.

3. Your account

You agree to:

  • keep your password secure;
  • notify us immediately if you believe your account has been compromised;
  • ensure that the information associated with your account remains accurate.

You are responsible for taking reasonable steps to keep your login credentials secure. Please notify us promptly if you believe your account has been accessed or used without your permission.

4. Description of the Services

SecondSoil provides practical information and guidance to help people moving to and living in the Netherlands understand Dutch systems and everyday life. The Services may include human-recorded audio guides, articles, practical resources, and carefully selected links to third-party websites.

Some content and features are available free of charge, while others may require a paid subscription.

We may update or modify the Services from time to time for valid reasons, including to improve functionality, security, content or usability, respond to legal or regulatory requirements, or maintain technical compatibility. Where a change materially and negatively affects a paid Service, we will provide notice and respect any rights you have under applicable consumer law.

5. Subscriptions

Certain features of SecondSoil require a paid subscription.

The price, subscription period and any applicable trial or introductory offer will be shown before you purchase a subscription.

Subscriptions purchased through the Apple App Store or Google Play are processed through the relevant platform and are also subject to that platform's applicable payment, billing and subscription terms.

Where a subscription is set to renew automatically, it will continue to renew for the applicable subscription period unless it is cancelled before the renewal date in accordance with the relevant platform's cancellation process.

You can manage or cancel a subscription purchased through Apple through your Apple account settings and a subscription purchased through Google Play through Google Play's subscription management tools.

Cancelling a subscription normally prevents future renewals. Unless applicable law or the relevant platform provides otherwise, you will normally retain access to the paid features until the end of the subscription period you have already paid for.

Refunds and withdrawal requests relating to purchases made through Apple or Google Play are handled in accordance with the relevant platform's procedures and applicable consumer law.

Nothing in these Terms limits any statutory rights you may have as a consumer.

6. Acceptable use

You agree not to:

  • use the Services for any unlawful purpose;
  • upload malicious software or harmful code;
  • attempt to gain unauthorised access to our systems;
  • interfere with the operation or security of the Services;
  • copy, scrape, reproduce or distribute content except as permitted by these Terms or applicable law;
  • impersonate another person.

We may take reasonable and proportionate action, including suspending or terminating access, where a user materially breaches these Terms or where action is necessary to protect the security or lawful operation of the Services.

7. Intellectual property

All intellectual property rights in the Services, including but not limited to text, graphics, branding, logos, illustrations, audio, software, design and other content, remain the property of WordWorx B.V. or its licensors.

Subject to these Terms, we grant you a limited, personal, non-exclusive and non-transferable right to access and use SecondSoil for your own personal, non-commercial purposes for as long as you are entitled to access the Services.

You may not copy, reproduce, modify, distribute, sell, commercially exploit or create derivative works from protected SecondSoil content without our prior written permission, except where permitted by applicable law.

8. Educational information

SecondSoil provides general educational and informational content about living in the Netherlands.

Although we take reasonable care to keep our content accurate and useful, laws, government procedures, costs, requirements, and other information may change over time. We therefore cannot guarantee that all information will always be complete, current or applicable to your individual circumstances.

Information provided through SecondSoil is based on sources and information that we consider reliable at the time of publication or review. Government rules, procedures, fees, eligibility requirements, contact details and other third-party information may change without notice.

While we take reasonable care in preparing and updating our content, we do not guarantee that every item of information will be error-free, complete or continuously up to date. Users should verify important or time-sensitive information with the relevant official authority or other appropriate source before acting on it.

If you become aware of information in SecondSoil that may be inaccurate or outdated, please let us know at hello@secondsoil.app so that we can review it.

The Services do not constitute legal, immigration, tax, financial, medical or psychological advice. Where a decision is important or depends on your individual circumstances, you should check the relevant official source or obtain appropriate professional advice.

9. Availability

We aim to keep the Services available at all times but cannot guarantee uninterrupted access.

We may temporarily suspend access where reasonably necessary for maintenance, security, updates or technical reasons. Nothing in this section affects your statutory rights where the Services fail to conform to the contract or where applicable law requires us to provide updates or remedies.

10. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, or any mandatory rights or remedies available to you under consumer law.

To the extent permitted by applicable law, WordWorx B.V. is not responsible for losses that were not reasonably foreseeable when you entered into the contract or that result from circumstances outside our reasonable control.

SecondSoil is intended for personal, non-commercial use. To the extent permitted by applicable law, we are not responsible for business losses arising from use of the Services.

To the extent permitted by applicable law, WordWorx B.V. is not responsible for loss arising solely because information provided through SecondSoil has become inaccurate, incomplete or outdated after publication, where we have taken reasonable care in preparing and maintaining that information.

11. Third-party links and services

SecondSoil may contain links to websites, services or resources operated by third parties, including government bodies and other external organisations.

These links are provided to help users find relevant information. Third-party websites and services are controlled by their respective operators and may be subject to their own terms and privacy policies.

We take reasonable care when selecting external resources but are not responsible for the availability, content or practices of third-party websites.

12. Privacy

Your use of the Services is also governed by our Privacy Policy.

Please read our Privacy Policy to understand how we collect, use and protect your personal data.

13. Suspension and termination

We may suspend or terminate your account where:

  • you materially breach these Terms;
  • we are required to do so by law;
  • continued access could compromise the security or integrity of the Services.

You may stop using the Services at any time.

Suspending or deleting a SecondSoil account does not necessarily cancel a subscription purchased through Apple or Google Play. You are responsible for managing or cancelling your subscription through the platform through which it was purchased.

Where we terminate a paid Service, we will respect any refund, remedy or other rights you have under applicable consumer law.

14. Changes to these Terms

We may update these Terms where reasonably necessary, for example because of changes to the Services, applicable law, security requirements or our business operations.

Where a change materially affects your rights or obligations, we will provide reasonable advance notice where required by law.

If a change materially and negatively affects a paid Service, you may have the right to terminate the affected contract under applicable consumer law.

15. Governing law

These Terms are governed by the laws of the Netherlands. If you are a consumer residing in another country, you also retain any mandatory consumer protection rights that apply to you under the laws of your country of residence.

Any dispute arising in connection with these Terms shall be submitted to a court with jurisdiction under applicable law.

16. Complaints

If you have a complaint about SecondSoil or a paid subscription, please contact us at hello@secondsoil.app. We will aim to investigate and respond within a reasonable period.

This does not affect any statutory rights or remedies available to you.
